Establishing whether you have grounds for a claim

Many people who experience an amputation will have been injured in a road traffic accident, during time in the military, at work or through clinical negligence.

That can involve obtaining CCTV from when you had an accident, interviewing witnesses, reviewing medical records and obtaining medical expert reports, or looking at the way a workplace was organised to establish the cause of an injury.

Do I have a claim for amputation compensation?

Knowing whether you have a claim is not straightforward. We need to be able to prove three key things for a successful claim:

A duty of care was owed
This duty of care was breached
That breach resulted in your loss

Did the person you hold responsible for your injury owe you a legal duty of care?

For example, an employer owes their employees a duty to protect their health and safety at work, while road users owe each other a duty of care to act with due care and attention. Establishing whether a duty of care existed is critical to have a claim.

Did the defendant act in a way that breached their duty of care?

For example, failing to take an action that they reasonably should have (e.g. an employer not taking proper steps to provide a safe working environment or a motorist not driving with due care and attention). Alternatively, the defendant may have taken an action that breached their duty of care (e.g. a surgeon removing a limb that did not require amputation).

Did the breach directly cause your amputation or make it worse than it would otherwise have been if the duty of care had not been breached?

For example, a direct cause might be where an employer fails to provide proper training on a piece of equipment, leading to improper use which causes an injury resulting in amputation. Situations where a breach of duty could make an amputation worse include where a doctor fails to promptly give the correct diagnosis and/or treatment for a medical issue e.g. a serious infection, which means more of a limb needs to be removed than would likely have been the case if proper care had been given at the right time.

Is there a time limit to claim amputation compensation?

In most circumstances, you will have three years to make a claim for an amputation where someone else was at fault. However, exactly when this three-year period begins is not always immediately obvious and there are exceptions that can mean you have longer to claim, so it is important to speak to an expert amputation claims lawyer for advice.

Where the three-year time limit applies, it will not necessarily start from the date on which you experienced your injury. The time limit will be counted from the ‘date of knowledge’, which is the date on which you knew you had been injured and that someone else’s negligence was responsible.

In other situations, a different time limit may apply. For example, where the injured person was under the age of 18, the time limit only applies from their 18^th birthday, giving until they turn 21 for them or their family to make a claim. If the person who experienced the amputation does not have the mental capacity to make a claim, there is no time limit for their next of kin to claim on their behalf.

How long does it take to get compensation for an amputation?

The honest answer is that it completely depends on the situation. We always aim to get the right settlement for people as quickly as we can, but the reality is that with these types of serious injury claims, it is likely to take over a year to see a settlement.

That said, we realise that people living with an amputation often have urgent need of financial support, so our team do everything we can to secure the support you need while your claim is ongoing. Where interim damages can be agreed, this can help to make sure you have financial security and the right rehabilitation care while your claim is ongoing.
